Additional vacations for police officers.
Allocate the following types additional holidays:

— psychological rehabilitation of the employee;
- in other exceptional cases

Leave for a police officer upon dismissal
Upon dismissal of a police officer, at his request, leave is granted (with wording for personal reasons) for a duration of 30 calendar days with the preservation of monetary allowance in the following cases:
- with service experience of 20 years or more - in any of the last three years until reaching age limit stay in the service;
- in the year of dismissal from service due to health reasons;
- in the year of dismissal due to a reduction in position;
- an employee, after he reaches the maximum age of stay in the service.

The specified leave is granted only once for the entire period of service.

Holidays for police officers and (hereinafter referred to as civilian workers) are regulated by different laws, but in general, the situation in terms of the number of vacation days is similar. Serious differences arise in cases where police officers are granted seniority leave, for civilian workers such situations can only be in the case of additional contracts, while for police officers they are provided for in federal law. In addition, police officers are not entitled to unpaid leave, while civilian workers such holidays are granted without saving wages.

The main difference is that, for the most part, the vacations of policemen are regulated not by the Labor Code, but by Federal Law No. 342, therefore, they have many differences from the usual ones. Since the employees of the Ministry of Internal Affairs perform work associated with a danger to life and health, the legislation provides for various benefits, compensations, and the like. Among other things, they are granted increased leave, and in addition to it, they also have the right to an additional one.

What holidays are provided?

The rest of police officers is regulated by Federal Law No. 342. As it says, vacations for employees of the internal affairs bodies are provided for as follows;

  • additional;
  • for personal reasons;
  • other.

Basic vacation

Let's list the most important rules for which it will be provided to the police:

  • They must rest every year for 30 days. For the first year of service, the duration will be determined by the number of months worked using a simple formula: the number of days set per year is multiplied by the number of months worked and divided by 12. For example, if an employee has been working since the beginning of May and has worked for 8 months as a result, he will receive: 30 x 8 / 12 = 20 days.
  • If he started the service in October, worked 3 months and thus received: 30 x 3 / 12 = 7.5 days, then these days will not be issued as a separate vacation, but instead they should be added to the next one. This is true for all holidays in the first year of work, if their duration does not reach 10 days.
  • If special circumstances arise, then the previously agreed and scheduled vacation can be postponed by order of the head. If this happens, then the employee must be compensated later - after the circumstances cease to operate, and the opportunity arises, he will receive priority in choosing the time.
  • An additional vacation can be combined with the main one, but there is a limitation - the total duration of the rest obtained in this way should not be more than 60 days in a row. However, if it takes time to travel to the place where the rest will be spent, it is not taken into account in its duration, as well as the time to return.
  • It is also possible to divide the vacation into an arbitrary number of parts, but there is a condition that must not be violated - the largest part must consist of at least 14 days. And no matter how many parts the employee wishes to divide his vacation, travel time will always be given only once a year.
  • Vacation days over thirty, if the employee so desires, can be replaced by financial compensation. It will be determined based on the amount per day multiplied by the number of replacement days.
  • If there was a transfer to another place, then the remaining unused vacation should be provided at the old place, and only if it is not possible to do this, in a new way.

Additional leave for seniority

There are several types of additional holidays for police officers. This:

  1. For length of service - it is given from the following calculation:
  • with a service life of 10 years - 5 calendar days;
  • from 15 years - 10 days;
  • from 20 years - 15 days.
  1. - is from 10 days.
  2. For irregular working hours - from 3 to 10 days.

For personal reasons

This type of rest can be taken any number of times - depending on the circumstances. However, its duration is not more than ten days. We list the circumstances in connection with which it is provided:

  • serious illness or death of a close relative;
  • a fire or other natural disaster that caused an injury to an employee or his immediate family;
  • the employee needs psychological rehabilitation;
  • other special cases.

In addition, one more leave can be distinguished, also provided for personal reasons, but having different parameters: it is given only to an employee with an experience of twenty years or more, at the end of the service - or before retirement (no more than three years) , or before reduction. It lasts, like the usual one, thirty days, while the allowance is retained by the employee. The police officer has the right to it only once during the entire service. If this right has not been used, financial compensation is made, calculated in the same way as in the usual case.

Other holidays

In addition to these categories, there are other vacations for police officers. First of all, these are holidays in, but along with them also creative, related to training and others provided for by the legislation of Russia.

Results

We briefly summarize the main features inherent in the holidays of police officers:

  • If in the first year of service the leave does not reach ten days, it will simply be added to the next.
  • You can divide the main vacation, however, so that there is a part that lasts at least fourteen days in a row.
  • Additional rest can be transferred so that it joins the main one, or taken separately - this is determined by the desire of the employee himself.
  • You cannot get a vacation lasting more than sixty days in a row - if an employee has the right to more days, then you will have to break it into several parts. This rule does not apply to employees working in the Far North or in areas equivalent to it.

Before leaving

It must be provided to the employee upon dismissal, except when he is dismissed for gross violations of discipline. This vacation period is sometimes compensated by a cash payment, and its duration is equal to the standard vacation of a policeman - 30 days. But to get it you need to have an experience of 20 years or more.

Upon dismissal, at the request of the employee himself, leave may also be due, but this will depend on various circumstances. This is described in detail in Federal Law No. 342 (Article 56, Part 11).

We note an important fact: in this case, the employee’s service ends on the day before the start of the vacation, that is, it will no longer be possible to extend it as usual.

Provision procedure

Registration of rest in the police is quite simple, in a few steps:

  1. Served.
  2. A schedule is drawn up and approved by the management.
  3. An order is issued.

After the report is confirmed by the order of the management, the employee can leave for the agreed period of time to rest and receive the payments due to him.

A sample report is attached to the article. It must contain:

  1. Cap with the name of the unit and the name of the head.
  2. The text of the report with a request for leave, indicating its type, duration and other important parameters.
  3. Full name of the employee, his position, signature and date.

But even after approval, a transfer can occur. Possible reasons for it are:

  • temporary disability;
  • the need to perform official duties during vacation;
  • other cases provided for by law.

A transfer is also possible, for which the employee himself applied, since certain circumstances arose due to which he needed to shift the start date of the holiday.

For the reasons mentioned above, it can also be done as compensation for the time taken from the police.

Even after an employee has gone on vacation, it is likely that he will be called back to duty before he has completed his entire term.

However, two conditions must be met:

  • he consented to this;
  • carried out with the consent and by order of his immediate superior.

According to Federal Law No. 342 (Article 64), it is allowed to call a policeman only when his absence does not allow the organization to perform its duties properly.

Police officers are classified as civil servants. Therefore, they are granted longer vacation periods. Moreover, the vacation of police officers consists of several periods and may increase depending on the length of service, the number of night shifts and other circumstances. In addition, all other types of leave provided for by law apply to police officers.

Types of vacations for police officers - duration

It should be noted several types of such periods that are established for employees of the system of internal affairs bodies.   • The annual paid leave of police officers is granted for 35 days. This is the base value. The duration increases after 10 years of service by 5 days, after 15 - by another 15 days, and after 20 - by another 5 days. If the rest period was not fully used in a given year, the employee either receives compensation for this, or spends the remaining days next year.

Police leave for family reasons

This is a short period, which takes a maximum of three days. There are several circumstances under which the specified time may be granted:

  • death of a close relative;
  • own wedding;
  • another good reason is connected with the police officer himself or with his close relative.

The basis for granting such a period is an application. In this case, the application must contain an indication of a specific circumstance. In some cases, it will need to be confirmed in writing, because such days will be paid as working days.

How many days is such a period is indicated in the Regulations on the service in the Department of Internal Affairs. The main norms are contained in the labor legislation. According to them, every employee of the internal affairs body has the right to receive a short period in the event of the birth of a child.

As a rule, three days are provided. In fact, this is a family circumstance. Therefore, it is necessary to write a statement indicating the birth of a child as the reason.

The main vacation of a police officer - how many days is it?

As mentioned above, the main vacation of a police officer is 35 days. It does not include Sundays and public holidays. For example, if during the rest there are 5 Sundays and two holidays, then it will increase and amount to 42 days.

How many days of rest will also depend on the length of service. In addition, officials of the internal affairs bodies are on duty in investigative and operational groups, patrol the streets at night, and so on. Each such duty is compensated by rest days. And if the employee is a donor, then he also receives additional days.

On average, a standard rest is at least 40 - 45 days. If a person works in a temporary detention center or similar units, they are entitled to additional days.

Additional time is also provided for seniority. To find out how many days the rest will be, you should know exactly your preferential length of service. After all, some services count in the calculation of one year of work for one and a half years of service.

When the period of service exceeds 10 years, the employee will receive an additional 5 days. After 15 - his rest will increase by another 5 days and so on.

Length of service includes the time of study at the university. However, this period is not included in the calculation for the rest. That is, for calculating a pension, the length of service will be, for example, 10 years, and for rest it will be only 7.5.

This concept means a vacation of 30 days upon dismissal. It is granted three years before retirement, subject to service of 20 years or more. If retirement is due to an age limit or reduction, such time is given in the year of dismissal.

The same condition applies to the termination labor relations due to illness. At the same time, rest is paid according to the average daily earnings.

Types of vacations and the procedure for their provision to police officers.

For employees of the internal affairs bodies, the following types of leave are established with the preservation of pay:

1) main vacation;

2) leave for personal reasons;

3) vacation leave;

4) leave after graduation from an educational institution of higher professional education of the federal body executive power in the field of internal affairs;

5) additional holidays;

6) other types of holidays if their payment is provided for by the legislation of the Russian Federation.

Another annual leave provided for 30 calendar days, and for areas with severe and adverse climatic conditions - 45 calendar days.

It should be noted that when determining the duration of the main vacation, weekends and non-working holidays (but not more than 10 days) falling on the vacation period are not included in the number of calendar days of vacation.

lasting no more than 10 calendar days (excluding travel time to the place of vacation and back) is provided to an employee of the internal affairs bodies by order of the head of the federal executive body in the field of internal affairs or an authorized head in the event of a serious illness or death of a close relative of the employee (spouse (wife) , father, mother, father (mother), spouse (wife), son (daughter), sibling (sister), fire or other natural disaster that has befallen an employee or his close relative, as well as, if necessary, psychological rehabilitation of an employee and in other exceptional cases.

The number of vacations for personal reasons during the calendar year is not limited.

Vacation holidays provided to employees of internal affairs bodies studying in educational institutions of the Ministry of Internal Affairs of Russia in full-time education:

— winter vacation leave lasting 14 calendar days;

- summer holiday vacation lasting 30 calendar days.

The following types of additional leave are established for employees of internal affairs bodies:

Additional leave for length of service in the internal affairs bodies is granted to employees of the internal affairs bodies on a calendar basis at the rate of:

1) from 10 to 15 years of service - 5 calendar days;

3) more than 20 years of service - 15 calendar days.

Other types of holidays

An employee of the internal affairs bodies with a length of service in the internal affairs bodies in calendar terms of 20 years or more in any year of the last three years until he reaches the age limit for serving in the internal affairs bodies or in the year of dismissal from service due to health or in connection with the reduction of the position in the internal affairs bodies, at his request, leave for personal reasons for a period of 30 calendar days with the preservation of monetary allowance is granted. The specified leave is also granted to an employee who, in accordance with this Federal Law, is serving in the internal affairs bodies after he has reached the age limit for serving in the service and who has not used this leave before. This leave is granted once during the period of service in the internal affairs bodies.

Female employees of the internal affairs bodies, in accordance with labor legislation, are granted maternity leave.

Employees of the internal affairs bodies are granted parental leave, creative leave, leave in connection with training, as well as other leaves established by the legislation of the Russian Federation.

16. Types of disciplinary sanctions and the procedure for their application in the police.

Article 50. Disciplinary sanctions

1. The following disciplinary sanctions may be imposed on an employee of the internal affairs bodies in case of violation of official discipline, as well as in other cases provided for by this Federal Law:

3) severe reprimand;

4) warning about incomplete service compliance;

5) transfer to a lower position in the internal affairs bodies;

6) dismissal from service in the internal affairs bodies.

14. A disciplinary sanction imposed on an employee of the internal affairs bodies by an order of the head of the federal executive body in the field of internal affairs or an authorized head is valid for one year from the date of its imposition, and a disciplinary sanction announced publicly orally - within one month from the date of its imposition. A disciplinary sanction imposed on an employee by an order of the head of the federal executive body in the field of internal affairs or an authorized head is considered withdrawn after one year from the date of its imposition, if this employee has not been subjected to a new disciplinary sanction during this year.

15. Disciplinary sanctions provided for in Clauses 5 and 6 of Part 1 of Article 50 of this Federal Law shall be executed no later than two months from the date of issuance of the order to impose them. The specified period does not include periods of temporary disability of an employee of the internal affairs bodies, his being on vacation or on a business trip.

16. The execution of a disciplinary sanction imposed on an employee of the internal affairs bodies in the form of a transfer to a lower position in the internal affairs bodies is carried out in the manner established by Article 30 of this Federal Law.

17. The execution of a disciplinary sanction imposed on an employee of the internal affairs bodies in the form of dismissal from service in the internal affairs bodies is carried out in accordance with Chapter 12 of this Federal Law.

How many days is the main vacation of a police officer?

The main rest time for employees of the Ministry of Internal Affairs is 30 days. Holidays and Sundays are not included in the number, but Saturdays are counted.

In the system of the Ministry of Internal Affairs, rest time is distributed according to a schedule compiled for the year. The main type includes annual paid regular time. Additional include all other types, namely:

  • due to family circumstances (for example, in connection with a wedding);
  • for seniority;

  • for child care;
  • as participants in hostilities;
  • upon retirement.

Vacation time for family reasons is always not scheduled (unlike, for example, paid study leave). The duration of this type is determined by the management of the structural unit, depending on the importance of personal circumstances. The law also sets limits - up to 10 days.
