In accordance with paragraph 1 of Art. 8 federal law dated December 26, 2008 N 294-FZ "On the protection of the rights of legal entities and individual entrepreneurs in the exercise of state control (supervision) and municipal control" individual entrepreneurs are required to notify the start of certain types of entrepreneurial activity authorized by the Government Russian Federation in the relevant area the federal body executive power.

One of the achievements of the state policy in the field of reducing administrative pressure on business is the introduction by the Federal Law of December 26, 2008 No. 294-ФЗ “On the Protection of the Rights of Legal Entities and Individual Entrepreneurs in the Implementation of State Control (Supervision) and Municipal Control” of the legal institution “Notification Procedure for Starting implementation of certain types of entrepreneurial activity”.

What if my business moved or closed?

- Legal entities and individual entrepreneurs are required to additionally report in writing or in the form of an electronic document (application in any form) no later than within 10 working days from the date of making the relevant entries in the Unified State Register of Legal Entities or the EGRIP in the Office of the information:

On changing the location of the legal entity and (or) the place of actual implementation of activities;

On changing the place of residence of the individual entrepreneur and (or) the place of actual implementation of activities;

On the reorganization of a legal entity.

– Effective January 1, 2018 new order provision of public services in accordance with the extraterritorial principle.

b) The Regulations on the Federal Service for Supervision in the Sphere of Transport, approved by Decree of the Government of the Russian Federation of July 30, 2004 N 398 (Sobraniye Zakonodatelstva Rossiyskoy Federatsii, 2004, N 32, Art. 3345), shall be supplemented with subparagraph 5.5.1.1 of the following content:

"5.5.1.1. acceptance and accounting of notices of the commencement of certain types of work and services by legal entities and individual entrepreneurs according to the list approved by the Government of the Russian Federation;";

I. General provisions

1. These Rules establish the procedure for the submission by legal entities, individual entrepreneurs engaged in certain types of entrepreneurial activities to the authorized federal executive bodies (their territorial bodies) of notifications of the commencement of their activities (hereinafter referred to as the notification), as well as the procedure for accounting by these bodies of received notifications.

2. The notification is submitted by a legal entity or an individual entrepreneur intending to perform work (render services) (hereinafter referred to as the applicant) in accordance with the list of works and services as part of certain types of business activities in accordance with Appendix No. 1 (hereinafter referred to as the list of works and services).

3. An applicant who intends to perform works (render services) specified in paragraphs 1 - 18, 22 - 36 of the list of works and services, with the exception of activities in the territory to be serviced by the Federal Medical and Biological Agency, shall submit a notification to the Federal Service for Supervision in in the field of consumer protection and human well-being (its territorial body).

4. An applicant who intends to perform work (render services) specified in paragraph 3 of these Rules in the territory to be serviced by the Federal Medical and Biological Agency shall submit a notification to this Agency (its territorial body).

5. An applicant who intends to perform work (render services) specified in paragraphs 19 - 21 of the list of works and services shall submit a notification to the Federal Service for Supervision in the Sphere of Transport (its territorial body).

6. The notification is drawn up by the applicant in the form in accordance with Appendix No. 2 and submitted at the place of the alleged actual implementation of work (rendering of services) to the appropriate federal executive body (its territorial body) specified in paragraphs 3 - 5 of these Rules (hereinafter referred to as the authorized body), before the start of the actual performance of work (rendering of services).

II. Order of submission of notifications

7. The applicant submits a notification in 2 copies to the authorized body directly or sends it by registered by mail with a description of the attachment with a return receipt.

If a notification is submitted directly to the authorized body, the date of its submission is the day of registration of the notification with the authorized body. When a notification is sent by mail, the day of its submission is considered the day of sending the postal item.

8. Attached to the notice:

a) a copy of an extract from the Unified State Register of Legal Entities or from the Unified State Register of Individual Entrepreneurs;

b) a copy of the staging certificate legal entity or individual entrepreneur for registration with the tax authorities.

9. The official of the authorized body responsible for accounting for received notifications, on the day of receipt of the notification, registers it and puts a mark on both copies of the notification indicating the date of its receipt and registration number.

One copy of the notice remains with the authorized body, and the second is handed over (sent) on the day of registration to the applicant.

10. In accordance with Part 6 of Article 8 of the Federal Law "On the Protection of the Rights of Legal Entities and Individual Entrepreneurs in the Exercise of State Control (Supervision) and Municipal Control", a legal entity or an individual entrepreneur is obliged to report in writing to the authorized body that registered the notification, information about the following changes:

a) change of the location of the legal entity and (or) the place of actual implementation of activities;

b) change of the place of residence of an individual entrepreneur and (or) the place of actual implementation of activities;

c) reorganization of a legal entity.

11. In accordance with Part 7 of Article 8 of the Federal Law "On the Protection of the Rights of Legal Entities and Individual Entrepreneurs in the Exercise of State Control (Supervision) and Municipal Control", information on the changes specified in paragraph 10 of these Rules shall be submitted to the authorized body within 10 days from the date of making appropriate changes by submitting (sending) to the authorized body an application in any form with copies of documents confirming the fact of making the relevant changes.

III. Accounting procedure for notifications

12. The authorized body keeps records of notifications by entering the following information into the register of notifications (hereinafter referred to as the register):

a) full and abbreviated, including company (if any), name of the legal entity, its legal form, surname, name, patronymic of an individual entrepreneur;

b) postal addresses the location of the legal entity, including its branches and representative offices, the places of actual implementation of the declared type (types) of activity, the places of actual implementation of the declared type (types) of activity of an individual entrepreneur;

c) the main state registration number of a legal entity or the main state registration number of an entry on the state registration of an individual entrepreneur;

d) taxpayer identification number, date of registration of a legal entity or individual entrepreneur with a tax authority;

e) type of activity, types of work (services) performed as part of the activity, the beginning of which is reported in the notification;

f) the date of receipt of the notification and its registration number.

13. An official of the authorized body responsible for accounting for notifications received enters information into the register on the day the notification is received.

The changes provided for in paragraph 11 of these Rules are made to the register within 5 working days from the date of receipt of the relevant documents by the authorized body.

14. The register is kept on paper and electronic media.

15. The information contained in the registry is open and publicly available.

The authorized body places the information contained in the register on its official website on the Internet within 10 days from the date of registration of the notification.

16. Authorized body at the written request of state authorities and bodies local government provides free of charge the information contained in the register in the form of extracts or reports the absence of the specified information on the day of receipt of the relevant request.

17. No fee is charged for registering notices, making entries in the register and providing information contained in the register.

In accordance with article 19.7.5-1 of the Code of the Russian Federation on administrative offenses the responsibility of legal entities and individual entrepreneurs is established for failure to submit a notice of the commencement of entrepreneurial activities if the submission of such a notice is mandatory, as well as for the submission of a notice of the commencement of entrepreneurial activities containing false information.

Submission by a legal entity or an individual entrepreneur of a notice of the commencement of entrepreneurial activity containing false information, if the submission of such a notice is mandatory, shall entail the imposition of an administrative fine on officials in the amount of five thousand to ten thousand rubles; for legal entities - from twenty thousand to thirty thousand roubles.

The consideration of cases of administrative offenses provided for in Article 19.7.5-1 of the Code of Administrative Offenses of the Russian Federation is within the competence of the court.
