GENERAL RESPONSIBILITIES OF TRANSPORTATION PARTICIPANTS
IN THE SECURITY FIELD

Participants in transportation operations dangerous goods must take appropriate safety measures depending on the nature and extent of the anticipated hazard. If there is a direct threat to public safety, transport participants must immediately notify emergency services and provide the information necessary for emergency services to take appropriate action.
In accordance with the provisions of international documents, some of the responsibilities assigned to various participants in transportation may be specified. A contracting party may, within the framework of its national legislation, assign the duties established for any specific participant in the carriage to another or other participants, subject to the fulfillment of their direct duties, in international documents. These derogations must be communicated by the Contracting Party to the secretariat of the United Nations Economic Commission for Europe, which will bring them to the attention of the Contracting Parties.
The requirements of international instruments regarding the definitions of participants in transport and their respective responsibilities do not interfere with the provisions of national legislation regarding legal consequences (criminal consequences, liability, etc.) arising from the fact that the participant in question is, for example, a legal entity, an employee, employer or employee.

Responsibilities of the main participants

NOTE: Specific provisions are made in the documents regarding radioactive materials.

Shipper
The sender of dangerous goods is obliged to present for transportation only goods that meet the requirements of international documents. He must, in particular:
a) make sure that dangerous goods are classified and approved for transportation in accordance with regulatory documents;
b) provide the carrier with information and data and, if necessary, the required transport documents and accompanying documents (permits, approvals, notifications, certificates, etc.);
(c) Use only packagings, large packagings, intermediate bulk containers (IBCs) and tanks (tank-vehicles, demountable tanks, battery-vehicles, MEGCs, portable tanks and tank-containers) that are approved and suitable for the carriage of the substances concerned. and have the prescribed markings;
d) comply with requirements regarding the method of shipment and restrictions on shipment;
(e) ensure that uncleaned and undegassed empty tanks (tank-vehicles, demountable tanks, MEGCs, portable tanks and tank-containers) or empty uncleaned
vehicles and bulk containers are properly marked and placarded and that empty, uncleaned tanks are closed as tightly as if they were full.
If the shipper uses the services of other participants in the transport (packer, loader, filler, etc.), he must take appropriate measures to ensure that the cargo complies with the requirements of the governing documents. In addition, he can use information and data placed at his disposal by other participants in the transport. When the shipper is acting on behalf of a third party, that person must advise the shipper in writing that we're talking about about dangerous goods, and provide the shipper with all the information and documents necessary for him to perform his duties.
Carrier
The carrier must, in addition to complying with the general safety provisions, in particular:
a) make sure that the dangerous goods to be transported are approved for transportation in accordance with the requirements of the governing documents;
b) ensure that the prescribed documentation is present on the transport unit;
c) visually verify that the vehicles and cargo have no obvious defects, are not leaking or cracked, and are properly equipped, etc.;
(d) ensure that the next test date for tank-vehicles, battery-vehicles, demountable tanks, portable tanks, tank-containers and MEGCs is not expired;
e) check whether vehicles are overloaded;
f) ensure that the hazard signs and markings prescribed for vehicles are displayed;
g) ensure that the equipment prescribed in the written driver instructions is carried on the vehicle.
Where appropriate, these actions are carried out on the basis of transport documents and accompanying documents by inspecting the vehicle or containers and, if necessary, the cargo.
With regard to subparagraphs a), b), e) and f), the carrier may use information and data placed at its disposal by other participants in the carriage. If the carrier discovers any violation of the requirements of the governing documents, he must not ship the cargo until this violation is corrected.
If during transportation a violation is discovered that may jeopardize the safety of transportation, it must be stopped immediately, taking into account the requirements relating to traffic safety, safe storage of cargo and public safety. Transportation can be continued only after the cargo is brought into compliance with the established rules.
The competent authority(ies) regulating transport for the remainder of the route may authorize the continuation of transport. In the event that the required compliance cannot be achieved or if permission for the remaining portion is not given, the competent authority(ies) shall provide the carrier with the necessary administrative assistance.
The same requirement applies in the event that the carrier informs the competent authority(ies) that the shipper has not informed him of the dangerous nature of the goods being transported and that, on the basis of the legislation applicable in particular to the contract of carriage , he wishes to unload, destroy or render harmless the cargo.
Consignee
The consignee is obliged to ensure prompt acceptance of the cargo, if there are no impeding reasons, and to ensure after unloading that the requirements of the governing documents concerning it are met. He is obliged, in particular:
a) in cases provided for by the governing documents, take the prescribed measures for cleaning and disinfecting vehicles;
b) ensure that containers and other transport equipment are free of hazard markings after they have been fully unloaded, cleaned and decontaminated. If the consignee uses the services of other participants in the transport (unloader, cleaning facilities, decontamination station, etc.), he must take appropriate measures to ensure compliance with the requirements of the governing documents. If, as a result of these checks, any violation of the requirements of the governing documents is discovered, the consignee must return the transport equipment to the carrier only after this violation has been eliminated.

Responsibilities of other participants
The governing documents list the remaining participants in the transportation and their responsibilities, and this list is not exhaustive. The responsibilities of these transportation participants arise from general duties transportation participants.
Loader
In the context of the requirements of the governing documents, the forklift performs, in particular, the following duties:
a) he must transfer dangerous goods to the carrier only if they are approved for carriage in accordance with the governing documents;
b) when handing over packaged dangerous goods or empty, uncleaned containers for carriage, he must check that the containers are not damaged. He must not hand over for carriage packages containing damaged containers, in particular leaking containers from which a hazardous substance is leaking or may leak, until the damage has been repaired; the same obligation also applies to empty, uncleaned containers;
(c) When loading dangerous goods into a vehicle or equipment, he must comply with special requirements relating to loading and handling of goods;
d) after loading dangerous goods into a container, it must comply with the requirements for affixing hazard markings in accordance with the requirements of the governing documents;
(e) When loading packages, he must comply with prohibitions regarding combined loading, taking into account dangerous goods already in the vehicle or container, as well as requirements regarding the separation of food, other consumables or animal feed.
In relation to a), d) and e), the forklift may use information and data placed at its disposal by other participants in the transport.
Packer
The packer must, in particular, comply with:
a) requirements concerning packing conditions or joint packing conditions, and,
(b) when he prepares packages for transport, requirements concerning markings and labels on packages.
Responsible for filling
The person responsible for filling must perform, in particular, the following duties:
a) before filling tanks, he must ensure that the tanks themselves and their equipment are in good technical condition;
(b) he must ensure that the next test date for tank-vehicles, battery-vehicles, demountable tanks, portable tanks, tank-containers and MEGCs is not expired;
(c) he must fill tanks only with dangerous goods approved for carriage in those tanks;
d) when filling the tank, he must comply with the requirements regarding the stowage of dangerous goods in adjacent compartments;
e) when filling the tank, he must comply with the maximum permissible degree of filling or the maximum permissible mass of contents per liter of capacity for the loaded substance;
f) after filling the tank, he must ensure that the shut-off devices are tight;
g) he must ensure that no dangerous quantity of the substance which has been filled remains on the external surfaces of the tanks;
h) when preparing dangerous goods for transport, he must ensure that the prescribed placards and placards or danger signs are placed on the tanks, vehicles and large and small bulk containers as required.
Tank container/portable tank operator
The tank container operator must, in particular:
a) ensure compliance with design, equipment, testing and marking requirements;
b) ensure that Maintenance bodies and their equipment is carried out in such a way that, under normal operating conditions, the tank container/portable tank meets the requirements of the governing documents until the next inspection;
c) conduct unscheduled inspections when the reliability of the hull or its equipment may be compromised by repair, modification or accident.

Security Advisor
Every enterprise whose activities involve the transport of dangerous goods or associated packaging, loading, filling or unloading operations shall appoint one or more dangerous goods safety advisors whose task is to assist in the prevention of the inherent hazards to persons and property of such activities. and the environment. The competent authorities of Contracting Parties may provide that these requirements do not apply to undertakings such as:
a) enterprises whose relevant activities involve the transport of dangerous goods in quantities less per transport unit than the quantities specified in the governing documents;
or
b) enterprises, main or additional activities which do not involve the transport of dangerous goods or related handling operations, but which sometimes carry out the domestic transport of dangerous goods posing a minor hazard or risk of contamination, or the handling operations associated with such transport.
The main task of the adviser, reporting in his work to the head of the enterprise, is to contribute, by all appropriate means and measures, within the framework of the relevant activities of the enterprise, to ensure the safety of these activities. The Advisor performs, in particular, following functions:
– monitoring compliance with the requirements governing the transport of dangerous goods;
– advising the enterprise on issues related to the transportation of dangerous goods;
– preparation of an annual report for the administration of his enterprise or, if necessary, for local authorities on the activities of this enterprise related to the transportation of dangerous goods.
The advisor’s functions also include control over the following types practices and procedures associated with the relevant activities of the enterprise:
– procedures to ensure compliance with requirements for the identification of dangerous goods transported;
– the practice of taking into account by the enterprise, when purchasing vehicles, special requirements determined by the nature of the dangerous goods being transported;
– procedures for checking equipment used for the transport of dangerous goods or for loading and unloading operations;
– ensuring proper training of enterprise employees and maintaining records of such training;
– application of appropriate emergency procedures in the event of any accident or incident likely to compromise safety during the carriage of dangerous goods or during loading and unloading operations;
– investigating the circumstances of serious accidents, incidents or serious violations observed during the carriage of dangerous goods or during loading and unloading operations, and, if necessary, preparing appropriate reports;
– taking the necessary measures to avoid the recurrence of accidents, incidents or serious violations;
– taking into account regulations and special requirements associated with the transport of dangerous goods when selecting and using the services of subcontractors or third parties;
– checking that workers involved in the transport of dangerous goods, their loading or unloading, have detailed instructions;
– taking measures to inform workers about the types of hazards associated with the transportation of dangerous goods, their loading and unloading;
– application of inspection procedures to ensure that vehicles have the required documents and safety equipment and that these documents and equipment comply with established rules;
– applying verification procedures to ensure compliance with loading and unloading requirements;
– availability of a security plan.
The functions of an adviser may also be performed by the head of the enterprise, an employee of the enterprise performing other duties, or a person not directly employed by the enterprise, provided that this person is capable of performing the duties of an adviser. Each undertaking concerned shall communicate, upon request, the details of its adviser to the competent authority or to the authority designated for this purpose by each Contracting Party.
If during transportation or during loading and unloading operations an accident occurs that causes damage to people, property or environment, advisor, collecting everything necessary information, prepares an accident report for the enterprise administration or, if necessary, for local authorities. This report cannot replace a management report that may be required by any other international or national regulation.
The Advisor must have a training certificate valid for the relevant modes of transport. This certificate shall be issued by the competent authority or authority designated for this purpose by each Contracting Party.
To obtain a certificate, the candidate must complete a training course and successfully pass an examination approved by the competent authority of the Contracting Party. The main objective of the training is to provide the candidate with sufficient knowledge of the hazards associated with the transport of dangerous goods, the laws, regulations and administrative provisions applicable to the relevant modes of transport, as well as the functions listed above.
The examination is organized by the competent authority or its designated examining body. The appointment of an examining body is made in writing.
This appointment may be of limited duration and must be based on the following criteria:
– competence of the examining organization;
– description of the form of examinations offered by the examining organization;
– measures aimed at ensuring the objectivity of examinations;
– independence of the organization in relation to any natural or legal entities, hiring advisors.
The examination is designed to test that candidates have the necessary knowledge to perform the security advisor functions listed above and to obtain certification, and must cover at least the following topics:
a) knowledge of the types of consequences that can result from an accident involving dangerous goods and knowledge of the main causes of accidents;
b) provisions of national legislation, international conventions and agreements, in particular on the following issues:
– classification of dangerous goods (procedure for classifying solutions and mixtures, structure of the list of substances, classes of dangerous goods and principles of their classification, nature of dangerous goods transported, physical, chemical and toxicological properties of dangerous goods);
General requirements for packaging, requirements for tanks and tank containers (types, codes, markings, design, initial and periodic inspections and tests);
– markings and danger signs, information boards and plates (applying markings and danger signs on packages, placing and removing information boards and plates);
– entries in transport documents (required information);
– method of shipment and restrictions on shipment (transportation by full load, transportation in bulk, transportation in intermediate bulk containers, container transportation, transportation in built-in or demountable tanks);
– transportation of passengers;
– prohibition of joint loading and precautions associated with joint loading;
– cargo separation;
– restrictions on quantities transported and exemptions in relation to quantities;
– cargo handling and stowage (loading and unloading – filling ratios – stowage and separation);
– cleaning and/or degassing before loading and after unloading;
– crews, professional training;
– documents on the vehicle (transport document, written instructions, vehicle approval certificate, driver training certificate, copies of any derogation documents, other documents);
– written instructions (application of instructions and crew protective equipment);
– requirements regarding surveillance (parking);
– traffic rules and traffic restrictions;
– operational release or accidental release of pollutants;

The examination includes a written assignment, which may be supplemented by an oral examination. The written exam consists of two parts:
a) The candidate is given a questionnaire containing at least 20 regular questions,
relating to at least the topics listed above. However, it may include multiple choice questions from which a choice must be made. In this case, two such questions are equivalent to one regular question. Among these topics Special attention should focus on the following topics:
– general preventative and safety measures;
– classification of dangerous goods;
general provisions on packaging, including provisions relating to tanks, tank containers, tank vehicles, etc.;
– markings and danger signs;
– information indicated in the transport document;
– cargo handling and stowage;
– crew, professional training;
– documents located on the vehicle and certificates related to transportation;
– written instructions;
– requirements concerning transport equipment.
b) Candidates undertake a practical task related to the functions of an advisor in order to demonstrate that they have the qualifications required to perform those functions.
Contracting Parties may decide that applicants intending to work in undertakings specializing in the transport of certain types of dangerous goods are interviewed only on substances associated with their work. These types of cargo include:
– class 1,
– class 2,
– class 7,
– classes 3, 4.1, 4.2, 4.3, 5.1, 5.2, 6.1, 6.2, 8 and 9,
– UN Nos. 1202, 1203 and 1223.
The advisor's certificate states that it is valid only for those types of dangerous goods and for which the applicant has been interviewed in accordance with the requirements set out in the governing documents.
The competent authority or examining body maintains a growing list of questions asked during the examinations. The certificate issued to the adviser is drawn up in accordance with the model given in the governing documents and is recognized by all Contracting Parties. The certificate is valid for five years. The validity of the certificate is extended from its expiration date for five years each time if its holder successfully passes the examination during the year preceding the expiration date of his certificate.
The examination must be approved by the competent authority. The purpose of the examination is to ensure that the holder of the certificate has necessary knowledge to perform advisory functions. The required knowledge, in addition to that listed above, must include knowledge of amendments made to the regulations since the last certificate was issued. The examination must be administered and proctored based on the requirements listed above. However, the certificate holder does not need to complete the practical task.

Dangerous Goods Incident Notifications
If an accident or serious incident occurs during the carriage of dangerous goods through the territory of a Contracting Party, the carrier must ensure that a report following the model prescribed in international instruments is submitted to the competent authority of the Contracting Party concerned. That Contracting Party shall in turn, if necessary, submit a report to the secretariat of the United Nations Economic Commission for Europe for the purpose of informing other Contracting Parties.
Compilation of a report in accordance with the requirements of international documents is necessary for incidents in which there was a release of dangerous goods or as a result of which there was a real danger of loss of product, or physical harm, property or environmental damage was caused, or if there was government intervention and the incident meets one or more of the following criteria:
Personal injury means an incident in which death or personal injury occurs directly attributable to the dangerous goods being transported and personal injury resulting
a) requires intensive medical treatment,
b) requires a hospital stay of at least one day, or
c) results in incapacity for work for at least three consecutive days.
Loss of product means release of dangerous cargo
a) transport category 0 or 1 in an amount of 50 kg/50 l or more,
b) transport category 2 in quantities of 333 kg/333 l or more, or
c) transport category 3 or 4 in quantities of 1000 kg/1000 l or more.

The loss of product criterion also applies if there is an imminent risk of loss of product in the above quantities. In general, such a hazard should be assumed if, due to structural damage, the cargo containment device is no longer suitable for further carriage, or if for some other reason an adequate level of safety is no longer ensured (for example, due to deformation of tanks or containers, tank overturning or fire in the immediate vicinity).
If the incident involves dangerous goods of Class 6.2, the reporting obligation applies without any restrictions on the quantity of goods.
In the event of an incident involving Class 7 materials, the product loss criteria are as follows:
a) any release of radioactive material from packages;
b) exposure leading to a violation of the limits established in the rules for the protection of workers and the public from ionizing radiation; or
c) when there is reason to believe that there has been a significant deterioration of any safety function of the package (cargo containment, containment, thermal insulation or criticality) that could render the package unsuitable for continued carriage without additional security measures.
Property or environmental damage means the release of dangerous goods, regardless of quantity, for which the estimated amount of damage exceeds EUR 50,000. Damage to any directly affected vehicles containing dangerous goods and modal infrastructure is not taken into account in this case. Government intervention means the direct intervention of authorities or emergency services during an incident involving dangerous goods, and evacuate people or close public roads (roads/railways) for at least three hours due to the danger posed by dangerous goods. General safety requirements for labor protection when transporting dangerous goods by road

1.1. Persons who have passed:

  • induction training;
  • fire safety instruction;
  • initial training at the workplace;
  • electrical safety instructions.

To perform the duties of a driver of a special vehicle transporting dangerous goods, persons who have a certificate for the right to drive this category of transport, who have no medical contraindications for this profession, and who have reached the age of 18, are allowed.

1.2. The employing organization must have a license to transport dangerous goods.
1.3. When transporting particularly dangerous goods, the consignee and the sender must obtain permission from the internal affairs authorities.
1.4. The permit is issued for one or more identical transportations, for a consignment of goods, but for no more than 6 months.

The heads of organizations are responsible for selecting persons accompanying dangerous goods and instructing them.

1.5. The responsibilities of the accompanying person include:

  • security of transported cargo;
  • briefing of security staff;
  • compliance with safety rules when moving cargo;
  • delivery of goods upon arrival.

1.6. The transportation route should not pass through large populated areas, recreation areas, or natural reserves.

1.7. The layout of vehicles for transporting flammable liquids and gases must meet the following requirements:

  • ensure the safety of service personnel;
  • the presence of a device for removing static electricity when they are filled (drained) and in motion;
  • The exhaust pipe of the tanker engine must be moved to the right side forward. The design of the exhaust pipe must allow the consumer to install a spark arrester;
  • availability of fire extinguishing means (at least two powder fire extinguishers).
  • the presence of “danger” signs, a flashing red light, a felt felt, and a container for sand weighing 25 kg;
  • presence of the inscription “flammable” on the sides and back.

  • for the convenience of work of maintenance personnel, vehicles must be equipped with stairs and platforms;
  • there must be a device for storing hoses during movement and boxes for storing spare parts, special tools and accessories;
  • a breathing device must be used to prevent pressure build-up in the tank;
  • Fuel hoses must be oil and petrol resistant and antistatic.

1.8. The driver uses PPE in accordance with the Rules for providing workers with special clothing, special footwear and other personal protective equipment, approved by Resolution of the Ministry of Labor of Russia of December 18, 1998 N 51; Personal protective equipment issued to employees must correspond to the nature and conditions of work and ensure labor safety. It is not allowed to purchase and issue personal protective equipment to employees without a certificate of conformity.

The characteristics of the issued PPE (nomenclature, issuance period and compliance standards) are established from the personal cards of workers employed at a particular workplace.
The regulatory nomenclature and timing for the issuance of PPE are determined in accordance with the Standard Industry Standards for the free issuance of special clothing, special footwear and other PPE to workers and employees.

Safety requirements before starting work when transporting dangerous goods

  • device for removing static electricity;
  • the condition of the muffler, which must be brought forward;
  • serviceability of the flashing lamp;
  • presence of safety signs;
  • presence of at least 2 fire extinguishers;
  • hose fastening devices;
  • fastening the propeller shaft bolts.

In addition, check the car’s fuel supply, oil, coolant and brake fluid, and the electrolyte level in the batteries.
2.5. Before leaving for the route, the driver confirms the serviceability of the vehicle by signing waybill.

Safety requirements during work transporting dangerous goods

3.1. The engine is started using a starter. The starting handle may only be used in exceptional cases. In this case, the following rules must be observed:

Without turning on the ignition, crank the crankshaft and make sure that the gearbox lever is in working condition. Then turn on the ignition. Turn the starting handle in a circle from bottom to top, without grasping the handle. When starting the engine with manual adjustment, set the ignition timing later than the ignition timing. Do not allow unauthorized persons to start.

3.2. Control over the loading and unloading of dangerous goods is assigned to the representative of the consignee.
3.3. Loading and unloading operations with dangerous goods must be carried out at specially equipped posts.
3.4. Drums with dangerous goods can only be moved along specially constructed ladders and decks.

3.5. When transporting dangerous goods in a convoy, the following requirements must be met:

  • the distance between cars must be at least 50 m;
  • in mountainous conditions - at least 300 m;
  • When visibility is less than 300 m, the transportation of dangerous goods is prohibited.

3.6. When transporting particularly dangerous goods, parking of vehicles in populated areas is prohibited.
3.7. When transporting particularly dangerous goods in a convoy of 5 vehicles, there must be a reserve vehicle in the convoy.
3.8. Transportation and cleaning of containers is carried out in the same manner as the transportation of dangerous goods.
3.9. Operations for transferring, receiving and dispensing leaded gasoline must be mechanized.
3.10. The driver of the fuel tanker must be on the windward side with the engine turned off.
3.11. The speed of the vehicle (fuel tanker) should not exceed 50 km/h, and on turns - 10 km/h. The driver of the refueling vehicle must start driving only after turning on the flashing light.
3.12. When draining gasoline from the tanker, check that the area is uncluttered and that there are no open sources of fire.

Safety requirements in emergency situations when transporting dangerous goods

4.1. The organization of the consignee (shipper) develops action plans in emergency situation with their delivery to the driver or accompanying person for each transportation and special emergency teams are allocated.
4.2. The emergency action plan for eliminating the consequences of accidents establishes the procedure for notification, arrival, actions of the emergency team, a list of necessary equipment and tools and the technology for their use.

4.3. If you are involved in a motor vehicle accident, you must:

  • call a traffic police inspector;
  • notify management and call an emergency team.

Safety requirements after completion of work on the transportation of dangerous goods

5.1. After transporting dangerous goods, the driver of a vehicle is obliged to park the vehicle in the place designated for its parking. Turn off the engine, and in winter, drain the water from the cooling system to prevent it from freezing.
5.2. Clean the machine from dirt, tighten bolted connections (disinfect if necessary). Add lubricant where necessary.
