In the article “Changes in legislation that will revolutionize the pharmaceutical market in 2018” in the magazine “New Pharmacy” No. 12, 2017. it is written that the Federal Law of July 29, 2017 No. 242-FZ “On Amendments to Certain Legislative Acts Russian Federation on application issues information technologies in the field of health protection" obliges pharmacies to enter information about employees into the Federal Register of Medical Workers. The law comes into force on January 1, 2018. Pharmacies will have to participate in maintaining the Federal Register. The procedure is published on the website portal.egisz.rosminzdrav.ru. The Ministry of Health will make an initial entry about graduates of universities and secondary educational institutions who have been accredited into the register; the law gives the department one month to do this. Then the obligation to enter information about pharmaceutical specialists will pass to the employer, and the period for pharmacies will be only five days. Question: Are commercial pharmaceutical organizations really required to enter data on the pharmacists/pharmacists working for them into the register of medical workers? When does this obligation begin?

Answer:

Article 3 of the Federal Law of the Russian Federation dated July 29, 2017 N 242-FZ “On amendments to certain legislative acts of the Russian Federation on the use of information technologies in the field of health protection”, from January 1, 2018, a number of changes are made to the Federal Law of the Russian Federation dated November 21. 2011 N 323-FZ “On the fundamentals of protecting the health of citizens in the Russian Federation” in terms of information support in the field of healthcare. According to the norms new edition Article 91 of Law No. 323-FZ Information Support in the healthcare sector is carried out, including through information systems pharmaceutical organizations. Information systems in the field of healthcare collect, store, process and provide information about bodies, organizations of state, municipal and private systems health care and on the implementation of medical and other activities in the field of health care. Pharmaceutical organizations, along with other bodies and organizations, are operators of information systems in the field of healthcare. Requirements for information systems of pharmaceutical organizations are established by the Ministry of Health of the Russian Federation. According to the new Article 91.1 of Law No. 323-FZ, in order to ensure citizens’ access to healthcare services in electronic form, as well as the interaction of information systems in the field of healthcare by the authorized federal body executive power the Unified State Information System in the field of healthcare (hereinafter referred to as the Unified System) is being created, developed and operated. The unified system includes: 1) information contained in federal information systems in the field of healthcare, federal databases and federal registers in the field of healthcare, maintained by the authorized federal executive body using a unified system; 2) information about medical organizations, with the exception of medical organizations subordinate to federal executive authorities, in which federal laws military service or equivalent service is provided; 3) information about persons who participate in the implementation medical activities; 4) information about the persons who are health care, as well as about persons in respect of whom medical examinations are being carried out, medical examinations and medical examinations; 5) information about medical documentation, the composition of which makes it impossible to determine the state of health of a citizen, and information about the medical organization in which the medical documentation is created and stored; 6) information statistical observation in the field of healthcare, as well as summary analytical information on the implementation of medical activities and the provision of medical care; 7) information on the organization of the provision of high-tech medical care; 8) information necessary for monitoring and control in the field of procurement of medicines to meet state and municipal needs; 9) information about the organization of provision of citizens medicines For medical use, medical products (medical products) and specialized medical nutrition products; 10) classifiers, reference books and other regulatory and reference information in the field of healthcare, the list, procedure for maintaining and using which are determined by the authorized federal executive body. Suppliers of information to the unified system include medical organizations and pharmaceutical organizations. As can be seen from the above-listed information included in the Unified System, information about pharmaceutical organizations and pharmaceutical workers do not appear in the Law. It should be noted that even for private medical organizations, the above innovations come into force only from January 1, 2019. We also note that to date, by-laws regulating the conduct of Unified system not yet published. The draft “Regulations on the Unified State Information System in the Sphere of Healthcare” has been published on the official website of the Government of the Russian Federation. At the same time, in the Draft Regulations attached to the Draft “Composition of information of the unified state information system in the field of healthcare provided to users of the specified system" includes the "Federal Register of Medical Organizations" and the "Federal Register of Medical Workers". In relation to pharmaceutical organizations and employees, there are no such registers in the above-mentioned Draft Contents of Information.
