Working hours for teaching staff

In accordance with Art. 333 Labor Code The Russian Federation establishes reduced working hours for teaching staff - no more than 36 hours per week.

The length of working time for teaching staff is determined by Decree of the Government of the Russian Federation dated April 3, 2003 No. 191 “On the duration of working time (standard hours of teaching work per wage wages) teaching staff" (hereinafter referred to as the Resolution).

According to the appendix approved by the Resolution, teaching workers, depending on their position and (or) specialty, taking into account the characteristics of their work, are provided with:

The procedure for regulating the working hours and rest time of teaching staff, taking into account the peculiarities of the activities of educational institutions of various types and types, is determined by the Regulations on the peculiarities of the working and resting hours of teaching and other employees of educational institutions, approved by order of the Ministry of Education and Science of Russia dated March 27, 2006 No. 69.

The performance of pedagogical work by teachers, lecturers, trainers, teachers of additional education (hereinafter referred to as teaching staff conducting teaching work) is characterized by the presence of established time standards only for performing pedagogical work related to teaching work.

The normalized part of the working time of employees conducting teaching work is determined in astronomical hours and includes lessons (training sessions) (hereinafter referred to as training sessions) regardless of their duration and short breaks (changes) between each training session established for students, including “dynamic hour” for 1st grade students. In this case, the number of hours of the established training load corresponds to the number of hours spent by the specified employees training sessions lasting no more than 45 minutes. The performance of teaching work is regulated by the class schedule.

For teaching work performed with the consent of teaching staff in excess of established norm hours per wage rate, additional payment is made according to the received wage rate in a single amount in the manner determined by the Ministry of Education and Science Russian Federation.

Teachers who cannot be provided with a full teaching load are guaranteed payment of the salary rate in full, provided that they are supplemented with other teaching work to the established standard hours in the following cases:

Teachers of grades 1-4 when transferring teaching lessons in a foreign language, music, visual arts And physical culture specialist teachers;

Teachers of grades 1-4 in rural general education institutions with a non-Russian language of instruction who do not have sufficient training to teach Russian language lessons;

Russian language teachers in rural primary secondary schools with non-Russian language of instruction;

Physical education teachers of rural educational institutions, foreign language teachers of general educational institutions located in the villages of logging and rafting enterprises and chemical forestry enterprises.

Teachers of general education institutions and teachers of pedagogical schools and pedagogical colleges, whose teaching load is reduced during the academic year for reasons beyond their control compared to installed load, until the end of the academic year the following is paid:

Wages for the actual number of hours if the remaining workload is higher than the established rate;

Salary in the amount of the rate, if the remaining workload is below the established rate for the rate and if it is impossible to supplement them with other teaching work;

The salary established before the teaching load was reduced, if it was set below the standard rate and if it is impossible to supplement them with other teaching work.

Teachers of institutions of primary vocational and secondary vocational education, whose teaching load for reasons beyond their control during the academic year is reduced in comparison with the established load, are paid until the end of the academic year a salary in the amount established during the tariff calculation at the beginning of the academic year.

Teaching staff must be notified of a reduction in the teaching load during the year and of additional teaching work no later than two months in advance.

The form of additional workload can be teaching work without additional pay in an extended day group, club work, work to replace absent teachers, conducting individual home lessons with students, organized in accordance with a medical report, performing partially or in full work on class management, inspection written works, extracurricular activities in physical education and other pedagogical work, the scope of which is regulated by the educational institution.

The performance of another part of the teaching work by teaching staff is carried out during working hours, which are not specified in terms of the number of hours. This part of the teaching work follows from the job responsibilities of teaching staff provided for by the charter educational institution, internal labor regulations of the educational institution, tariff and qualification (qualification) characteristics, and is regulated by schedules and work plans, incl. personal plans teaching worker, and includes:

Fulfillment of duties related to participation in the work of pedagogical, methodological councils, and work on conducting parent meetings, consultations, recreational, educational and other activities provided for by the educational program;

Organization and conduct of methodological, diagnostic and advisory assistance to parents (legal representatives), families educating children at home in accordance with a medical report;

Time spent directly on preparation for work on training and education of students, pupils, studying their individual abilities, interests and inclinations, as well as their family circumstances and living conditions;

Periodic short-term duty in an educational institution during the period educational process which, if necessary, can be organized in order to prepare for classes, monitor the implementation of the daily routine by students, pupils, ensure order and discipline during school time, including during breaks between classes established for the rest of students, pupils of varying degrees of activity, their food intake;

Fulfillment of additional duties assigned to teaching staff directly related to the educational process, with corresponding additional remuneration (class management, checking written work, managing classrooms, etc.).

The working hours of persons from among the teaching staff of educational institutions of higher professional education and educational institutions of additional professional education (advanced training) specialists within a 36-hour working week are determined taking into account the performance of teaching work, as well as the implementation of research, creative and performing work , experimental design, educational and methodological, organizational and methodological, educational, physical education, sports and recreational work.

The teaching schedule is regulated by the teaching schedule. The volume of teaching work of each teacher is determined by the educational institution independently depending on the qualifications of the employee and the profile of the department and cannot exceed 900 hours in an academic year - in educational institutions of higher professional education and 800 hours in an academic year - in educational institutions of additional professional education (advanced training) specialists.

The mode of performance by a teacher of duties related to research, creative, performing, experimental design work, as well as educational and methodological, organizational and methodological, educational, physical education, sports and recreational activities, is regulated by the internal labor regulations of the educational institution, plans of scientific- research papers, programs, schedules, etc.

The internal labor regulations of an educational institution and other local acts may regulate the performance of the specified work both directly in the educational institution and outside it.

The procedure for granting annual basic extended paid leave to teaching staff

In accordance with Art. 334 of the Labor Code of the Russian Federation, teaching staff are provided with an annual basic extended paid leave. The list of educational institutions in which work gives the right to extended leave, the names of positions and the duration of leave for each position are determined by Decree of the Government of the Russian Federation of October 1, 2002 No. 724 “On the duration of the annual basic extended paid leave provided to teaching staff” (hereinafter referred to as the Resolution ).

The annual basic extended paid leave is provided for the duration of:

Vice-rectors (deputy directors), with the exception of the first vice-rector, vice-rector (deputy director) for academic affairs, scientific work, evening and distance learning, distance learning and information technology, advanced training; deputy deans of faculties, directors (heads) of branches, heads of doctoral studies, postgraduate studies, research departments (sectors), educational departments (parts) and other educational structural units; managers (heads) of industrial practice, academic secretaries, provided that they conduct teaching work in the same educational institution of higher professional education or educational institution of additional professional education (advanced training) for specialists in the amount of at least 150 hours during the academic year;

Educators, music directors, physical education instructors, speech therapists, speech pathologists working full time in preschool groups for children with disabilities or in preschool sanatorium groups for children in need of long-term treatment, which are part of educational institutions for children of preschool and primary school age, preschool educational institutions;

Teachers of additional education of educational institutions of additional education for children working with students with disabilities within the limits of not less than the standard hours of teaching work, for which the wage rate is paid.

Annual extended paid leave of the duration established by the Resolution under consideration is used by teaching staff in positions of the same name with the name “senior” or “chief”.


The procedure for calculating length of service giving the right to early assignment of an old-age pension to teaching staff

In accordance with sub. 10 p. 1 art. 28 Federal Law dated December 17, 2001 No. 173-FZ “On Labor Pensions in the Russian Federation” persons, regardless of age, who have carried out teaching activities in institutions for children of any form of ownership for at least 25 years (as amended by the resolution of the Constitutional Court of the Russian Federation dated June 3, 2004 No. No. 11-P), have the right to receive an old-age labor pension before they reach the statutory retirement age.

The list of positions and institutions (hereinafter referred to as the List), as well as the procedure for calculating periods of work giving the right to early assignment of an old-age labor pension to persons who carried out teaching activities in institutions for children (hereinafter referred to as work experience) were approved by the Decree of the Government of the Russian Federation of October 29, 2002 No. 781 “On the lists of jobs, professions, positions, specialties and institutions, taking into account which an old-age labor pension is assigned early in accordance with Article 28 of the Federal Law “On Labor Pensions in the Russian Federation”, and on the approval of the rules for calculating periods of work giving the right to early assignment of an old-age labor pension in accordance with Article 28 of the Federal Law “On Labor Pensions in the Russian Federation”.

In accordance with the Rules for calculating periods of work, giving the right to early assignment of an old-age labor pension to persons who carried out teaching activities in institutions for children (hereinafter referred to as the Rules), work in the positions specified in clause 1 of the section “Name of Positions” of the List is counted in work experience, subject to its performance in the institutions specified in subparagraph. 1.1-1.14 of the “Name of Institutions” section of the List, and work in the positions specified in paragraph 2 of the “Name of Positions” section of the List - in the institutions specified in paragraph 2 of the “Name of Institutions” section of the List.

Periods of work performed before September 1, 2000 in positions in institutions specified in the List are counted in the length of service regardless of the condition of fulfillment of working time standards during these periods, and starting from September 1, 2000 - subject to fulfillment (in total for the main and other places of work) working time standards, with the exception of the following cases:

1. The length of working time (standard hours of teaching work per wage rate) for teaching staff is established on the basis of a reduced working time of no more than 36 hours per week.

2. Depending on the position and (or) specialty of teaching staff, the following working hours or standard hours of teaching work are established for the wage rate.

2.1. The working hours of 36 hours per week are determined by:

2.2. The working hours of 30 hours per week are established for senior educators (with the exception of senior educators specified in paragraph 2.1 of this Appendix).

2.3. The standard hours of teaching work are 20 hours per week for the wage rate is established:

teachers-defectologists;

speech therapist teachers.

2.4. The standard hours of teaching work 24 hours a week for the wage rate is established:

music directors;

accompanists.

2.5. The standard hours of teaching work of 25 hours per week per wage rate is established for educators who directly provide training, education, supervision and care for students (pupils) with disabilities.

2.6. The standard hours of teaching work 30 hours per week for the wage rate is established:

physical education instructors;

educators of organizations carrying out educational activities in basic general education programs, in which conditions have been created for the accommodation of pupils in a boarding school, as well as for the supervision and care of children in after-school groups, organizations for orphans and children left without parental care, organizations ( groups), including sanatoriums, for students (pupils) with tuberculosis intoxication, medical organizations, social service organizations carrying out educational activities as an additional type of activity (hereinafter referred to as medical organizations and social service organizations), (with the exception of educators provided for in paragraphs 2.5 and 2.7 of this Appendix).

2.7. The standard hours of teaching work of 36 hours per week per wage rate is established for educators of organizations carrying out educational activities in additional general education programs, educational programs of preschool education, educational programs of secondary vocational education, as well as those providing supervision and care for children (with the exception of educators for whom the norms of hours of teaching work for the wage rate are provided for in paragraphs 2.5 and 2.6 of this Appendix).

2.8. The standard hours of teaching work for the wage rate of teaching staff listed in subclauses 2.8.1 and 2.8.2 of this paragraph is taken to be the standard hours of educational (teaching) work, which is a standardized part of their teaching work (hereinafter referred to as the standard hours of educational (teaching) work ).

2.8.1. The standard hours of educational (teaching) work are 18 hours per week for the wage rate is established:

teachers of organizations carrying out educational activities in basic general education programs (including adapted ones);

teachers of organizations carrying out educational activities in additional general education programs in the field of arts, physical culture and sports;

teachers of additional education and senior teachers of additional education;

trainers-teachers and senior trainers-teachers of organizations carrying out educational activities on educational programs in the field of physical culture and sports;

speech therapists of medical organizations and social service organizations;

preschool foreign language teachers educational organizations;

2.8.2. The standard hours of educational (teaching) work of 720 hours per year per wage rate is established for teachers of organizations carrying out educational activities in educational programs of secondary vocational education, including integrated educational programs in the field of arts (with the exception of teachers specified in subclause 2.8.1 of this point), and for basic vocational training programs.

2. The norms of hours of pedagogical work for the wage rate of pedagogical workers, provided for in paragraphs 2.3-2.7 of this Appendix, are established in astronomical hours. The norms of hours of study (teaching) work, provided for in clause 2.8 of this Appendix, are established in astronomical hours, including short breaks (changes), dynamic pause.

3. Standard hours of teaching work for the wage rate provided for in paragraphs 2.5-2.7 of this Appendix, and norms for hours of educational (teaching) work provided for in paragraph 2.8 of this Appendix are calculated values ​​for calculating wages for teaching staff for the month, taking into account those established by the organization, carrying out educational activities, the volume of teaching work or educational (teaching) work per week (per year).

4. For pedagogical work or educational (teaching) work performed by a teacher with his written consent in excess of the established norm of hours for the wage rate or below the established norm of hours for the wage rate, payment is made from the established wage rate in proportion to the actually determined volume of pedagogical work or educational (teaching) work, with the exception of cases of payment of wage rates in full, guaranteed in accordance with paragraph 2.2 of Appendix 2 to this order to teachers who cannot be provided with an academic load in the amount corresponding to the norm of hours of educational (teaching) work established for weekly wage rate.

I. General provisions

1.1. The procedure for determining the teaching load of teaching staff stipulated in the employment contract (hereinafter referred to as the Procedure) determines the rules for determining the teaching load of teaching staff stipulated in the employment contract, the grounds for changing it, cases of establishing the upper limit of teaching load depending on the position and (or) specialty of the teaching staff. workers, taking into account the characteristics of their work.

1.2. When determining the teaching load of teaching staff, its volume is established for the implementation of educational (teaching) work in interaction with students by type educational activities, established curriculum (individual curriculum), ongoing monitoring of progress, intermediate and final certification of students.

1.3. The volume of the teaching load of teaching staff performing educational (teaching) work is determined annually at the beginning of the school year (training period, sports season) and is established by the local normative act organization carrying out educational activities.

1.4. The volume of teaching load established for a teaching worker is specified in the employment contract concluded by the teaching worker with the organization carrying out educational activities.

1.5. The volume of teaching workload of teaching staff (with the exception of teaching staff filling positions of teaching staff), established at the beginning of the academic year (training period, sports season), cannot be changed in the current academic year (training period, sports season) at the initiative of the employer with the exception of changes in the volume of teaching workload of teaching staff specified in subclause 2.8.1 of Appendix No. 1 to this order, in the direction of its reduction associated with a decrease in the number of hours according to curricula, study schedules, a reduction in the number of students, classes, groups, a reduction in the number of classes (classes-sets).

1.6. The volume of teaching workload of teaching staff (with the exception of teaching staff filling positions of teaching staff), established in the current academic year (training period, sports season), cannot be changed at the initiative of the employer for the next academic year (training period, sports season) except for cases of changes in the teaching load of teaching staff specified in paragraph 2.8 of Appendix No. 1 to this order, in the direction of its reduction associated with a decrease in the number of hours according to curricula, study schedules, a reduction in the number of students, classes, groups, a reduction in the number of classes (classes) -sets).

1.7. A temporary or permanent change (increase or decrease) in the teaching load of teaching staff compared to the teaching load specified in the employment contract is permitted only by agreement of the parties to the employment contract, concluded in writing, with the exception of changes in the teaching load of teaching staff towards its reduction provided for in clauses 1.5 and 1.6 of this Procedure.

1.8. The employer is obliged to notify teaching staff in writing about changes in the volume of the teaching load (increase or decrease), as well as the reasons that necessitated such changes, no later than two months before the proposed changes are made, except in cases where the change in the volume of the teaching load carried out by agreement of the parties to the employment contract.

1.9. Local regulations of organizations engaged in educational activities on the issues of determining the teaching load of pedagogical workers engaged in educational (teaching) work, as well as its changes, are adopted taking into account the opinion of the elected body of the primary trade union organization or other representative body of workers (if there is such a representative body).

II. Determination of the teaching load of teachers and lecturers for whom the norm of teaching hours is 18 hours per week for the wage rate, the grounds for its change

2.1. The teaching load of teachers and instructors is determined taking into account the number of hours in the curriculum, work programs of academic subjects, educational programs, and staffing of the organization carrying out educational activities.

2.2. Payment of the wage rate in full, subject to additional loading to the established standard hours with other teaching work, is guaranteed to the following teachers who cannot be provided with a teaching load in the amount corresponding to the standard hours of educational (teaching) work established for the weekly wage rate:

1-4 classes when transferring the teaching of foreign language, music, fine arts and physical education lessons to specialist teachers;

1-4 grades without necessary preparation for conducting Russian language lessons, organizations carrying out educational activities in educational programs of primary general education with the native (non-Russian) language of instruction, located in rural areas;

Russian language organizations carrying out educational activities in educational programs of primary general education with a native (non-Russian) language of instruction, located in rural areas;

physical culture of organizations carrying out educational activities according to general education programs located in rural settlements;

foreign language of organizations carrying out educational activities according to general educational programs, located in the villages of logging and rafting enterprises and chemical forestry enterprises.

2.3. When determining the teaching load for the new academic year, teachers and lecturers for whom the organization carrying out educational activities is the main place of work, its volume is maintained and the continuity of teaching academic subjects, courses, disciplines (modules) in classes (class sets), groups is ensured , with the exception of cases provided for in paragraph 1.7 of this Procedure.

Preservation of the volume of teaching load and continuity of teaching of academic subjects, courses, disciplines (modules) for teachers and teachers of final classes, groups is ensured by providing them with teaching load in classes (classes-sets), groups in which the study of what these teachers and teachers teach for the first time begins subjects, courses, disciplines (modules).

2.4. Teachers, as well as teachers of organizations carrying out educational activities in educational programs of secondary vocational education of a pedagogical orientation, applying the standard hours of educational (teaching) work of 18 hours per week for a salary rate, and for whom, for reasons beyond their control, the teaching load is reduced during the academic year in comparison with the academic load established at the beginning of the academic year, after the expiration of the notice period for its reduction, provided for in paragraph 1.8 of this Procedure, until the end of the academic year, as well as during the holiday period that does not coincide with the annual main extended paid leave and annual additional paid leave , paid:

wages for the actual remaining number of hours of educational (teaching) work, if it exceeds the norm of hours of educational (teaching) work per week established for the wage rate;

wages in the amount of a monthly rate, if the volume of the teaching load before it was reduced corresponded to the standard hours of educational (teaching) work per week established for the wage rate, and if it is impossible to supplement them with other teaching work;

wages established before the teaching load was reduced, if it was set below the standard hours of educational (teaching) work per week established for the wage rate, and if they cannot be loaded with other teaching work.

2.5. When entrusted to teachers of organizations implementing basic general education programs, for which specified organizations are the main place of work, responsibilities for teaching at home children who, for health reasons, cannot attend such organizations, the number of hours established for teaching such children is included in the teaching load of teachers.

2.6. The onset of holidays for students, including those studying at home, is not a basis for reducing the teaching load and salaries of teachers, including in cases where the conclusion medical organization, which is the basis for organizing home schooling, is valid only until the end of the school year.

2.7. The teaching load carried out to replace teachers and lecturers who are temporarily absent due to illness and other reasons is paid additionally.

III. Determination of the teaching load of additional education teachers, senior additional education teachers and the teaching (training) load of trainers-teachers, senior trainers-teachers, reasons for its change

3.1. The determination of the teaching load of additional education teachers, senior additional education teachers and the teaching (training) load of trainers-teachers, senior trainers-teachers, as well as its changes are carried out taking into account the specifics of the implementation of additional general education programs in the field of arts, physical education and sports, programs sports training in accordance with paragraphs 2.1, 2.2, 2.4-2.6 of this Procedure.

IV. Determination of the teaching load of teachers of organizations carrying out educational activities in educational programs of secondary vocational education, the norm of hours of educational (teaching) work for the wage rate of which is 720 hours per year, the grounds for its change

4.1. For teachers of organizations carrying out educational activities in educational programs of secondary vocational education, the standard hours of educational (teaching) work for the salary rate of which is 720 hours per year, the volume of the annual teaching load is determined based on 10 academic months.

Study load on weekends and non-working days holidays not planned.

4.2. For teachers on annual basic extended paid leave and (or) annual additional paid leave after the start of the academic year, the teaching load is determined based on its volume for the full academic year with the subsequent application of the conditions for its reduction provided for in paragraph 4.4 of this Procedure.

4.3. For teachers hired during the academic year, the volume of the annual teaching load is determined by the number of full months remaining until the end of the academic year.

4.4. In the event that the teaching load in the annual volume determined at the beginning of the academic year cannot be fulfilled by the teacher due to being on an annual basic extended paid leave or on an annual additional paid leave, at training camps, on a business trip, due to temporary disability, a certain his annual teaching load is subject to reduction by 1/10 for each full month of absence from work and based on the number of missed working days for an incomplete month.

4.5. In the event that the teacher actually performs educational (teaching) work on the day the certificate of incapacity is issued, on the day of departure on a business trip and the day of return from business trip There is no reduction in the teaching load.

4.6. The average monthly salary is paid monthly, regardless of the volume of teaching load performed by teachers in each month of the academic year, as well as during the holiday period, which does not coincide with the annual main extended paid leave and the annual additional paid leave.

4.7. Teachers of organizations carrying out educational activities in educational programs of secondary vocational education, applying the norm of hours of educational (teaching) work of 720 hours per year at the wage rate, and for whom, for reasons beyond their control, during the academic year the teaching load is reduced in comparison with the teaching load, established at the beginning of the academic year, or reduced on the grounds provided for in paragraph 4.4 of this Procedure, until the end of the academic year, as well as during the holiday period that does not coincide with the annual main extended paid leave and annual additional paid leave, wages are paid in the amount established in the beginning of the school year.

V. Features of determining the teaching load of teaching staff who are on parental leave until the child reaches the age of three, as well as persons filling the positions of teaching staff for a certain period of time, part-time, or performing other work along with the work specified in the employment contract

5.1. Determination of the teaching load of teachers, lecturers, additional education teachers, senior additional education teachers, trainers-teachers, senior trainers-teachers who are on parental leave until the child reaches the age of three years is carried out in accordance with Chapters I-IV of this Procedure, respectively , and is distributed for the specified period among other teaching staff.

5.2. Determination of the teaching load of teaching staff for certain period is carried out to fulfill the teaching load for the period of replacing temporarily absent teaching staff, as well as for the period of temporarily filling a vacant position before hiring a permanent employee.

5.3. Determining and changing the teaching load of persons filling part-time teaching positions, as well as by filling such positions along with the work determined employment contract(including heads of organizations carrying out educational activities, their deputies, other employees along with their main work) is carried out in accordance with Chapters I-IV and VI of this Procedure.

5.4. Determination of the teaching load for persons filling positions of teaching staff along with the work specified in the employment contract is carried out by concluding an additional agreement to the employment contract, which indicates the period during which the training (teaching) work will be carried out, its content, the volume of the teaching load and the size payment.

VI. Determination of the teaching load of teaching staff classified as teaching staff and the grounds for changing it

6.1. To determine the teaching load of teaching staff filling positions of the teaching staff (hereinafter referred to as teaching staff), annually at the beginning of the academic year for the structural divisions of the organization carrying out educational activities in educational programs of higher education, additional professional programs (hereinafter in this chapter - organization) , taking into account the areas of training they provide, the local regulatory act of the organization establishes the average volume of the teaching load, as well as its upper limits, differentiated by positions of the teaching staff.

6.2. The teaching load of each teaching staff member is determined depending on the position he or she occupies, the level of qualifications and cannot exceed the upper limits established for positions of the teaching staff in the manner established by paragraph 6.1 of this Procedure.

6.4. Time standards for the types of educational activities provided for in paragraph 6.3 of this Procedure, included in the teaching load of teaching staff, are independently determined by the organization and approved by its local regulations.

Time standards for types of educational activities included in the teaching load of teaching staff when implementing educational programs in the field of personnel training in the interests of defense and security of the state, ensuring law and order in federal government organizations, which are under the jurisdiction of federal government bodies specified in part 1 of Article 81 of the Federal Law of December 29, 2012 “On Education in the Russian Federation”, are established by the local regulatory act of the organization in agreement with the relevant federal government agency.

An academic or astronomical hour is taken as a unit of time in accordance with the established value of the credit unit used in the implementation of educational programs, in accordance with paragraph 28 of the Procedure approved by Order N 1367, paragraph 17 of the Procedure approved by Order N 1258, paragraph 18 of the Procedure approved by Order N 1259.

6.5. The ratio of the teaching load of teaching staff established for the academic year and other activities provided for by job responsibilities and (or) individual plan (scientific, creative, research, methodological, preparatory, organizational, diagnostic, therapeutic, expert, other, including related increasing one’s professional level), within the established working hours, is determined by the local regulatory act of the organization depending on the position of the employee.

VII. Establishing an upper limit for the teaching load of teaching staff

7.1. Depending on the position held, the teaching load of teaching staff is limited to an upper limit in the following cases:

7.1.1. In organizations carrying out educational activities in educational programs of secondary vocational education, teachers, the norm of hours of educational (teaching) work for whose salary rate is 720 hours per year, the upper limit of the teaching load is set in an amount not exceeding 1440 hours in the academic year;

7.1.2. In organizations carrying out educational activities in educational programs of higher education, the upper limit of the teaching load, determined by positions of the teaching staff in the manner provided for in paragraph 6.1 of this Procedure, is established in a volume not exceeding 900 hours in the academic year;

7.1.3. In organizations carrying out educational activities in additional professional programs, the upper limit of the teaching load, determined by positions of the teaching staff in the manner provided for in paragraph 6.1 of this Procedure, is established in a volume not exceeding 800 hours in the academic year.

7.2. The volume of the teaching load when working part-time with the same and (or) another employer in teaching staff positions should not exceed half of the upper limit of the teaching load, determined by teaching staff positions in the manner prescribed by paragraph 6.1 of this Procedure.

Length of working time (standard hours of teaching work per wage rate) of teaching staff

The length of working time (standard hours of teaching work per wage rate) for teaching staff is established on the basis of a reduced working time of no more than 36 hours per week.

Depending on their position and (or) specialty, taking into account the characteristics of their work, the following is established for teaching staff:

1. Working hours:

36 hours per week:

employees from among the teaching staff of educational institutions of higher professional education and educational institutions of additional professional education (advanced training) specialists;

senior teachers of preschool educational institutions, educational institutions of additional education for children and children's homes;

educational psychologists, social educators, teacher-organizers, industrial training masters, senior counselors, labor instructors;

methodologists, senior methodologists of educational institutions;

tutors of educational institutions (with the exception of tutors engaged in the field of higher and additional professional education);

heads of physical education of educational institutions implementing educational programs of primary vocational and secondary vocational education;

teachers-organizers of the basics of life safety, pre-conscription training;

instructors-methodologists, senior instructors-methodologists of educational institutions of additional education for children in sports;

30 hours per week - for senior teachers of educational institutions (except for preschool educational institutions and educational institutions for additional education of children).

2. Standard hours of teaching work per wage rate (standardized part of teaching work):

18 hours a week:

teachers of grades 1-11 (12) of educational institutions implementing general educational programs (including special (correctional) educational programs for students, pupils with disabilities);

teachers of educational institutions that implement educational programs of secondary vocational education of a pedagogical orientation (with the exception of teachers of such educational institutions who have a norm of teaching hours for a salary rate of 720 hours per year);

teachers of special disciplines 1-11 (12) classes of musical, artistic educational institutions;

25 hours a week - for educators working directly in groups with students (pupils, children) with disabilities;

30 hours a week:

physical education instructors;

educators in boarding schools, orphanages, after-school groups, boarding schools at general educational institutions (boarding schools), special educational institutions for children and adolescents with deviant behavior, preschool educational institutions (groups) for children with tuberculosis intoxication, health care institutions and social services;

36 hours per week - for teachers in preschool educational institutions, preschool groups of general education institutions and educational institutions for children of preschool and primary school age, in educational institutions for additional education of children, in dormitories of educational institutions implementing educational programs of primary vocational and secondary vocational education, and other institutions and organizations.

Notes

1. The working hours of teaching staff include teaching (educational) work, educational work, as well as other pedagogical work provided for qualification characteristics by position and features of the working hours and rest hours of teaching and other employees of educational institutions, approved in the prescribed manner.

2. The standard hours of teaching and (or) teaching work for the wage rate of teaching staff is established in astronomical hours. For teachers, instructors, additional education teachers, senior additional education teachers, trainers-teachers, senior trainers-teachers, the standard hours of teaching work per wage rate includes the lessons (classes) they conduct, regardless of their duration, and short breaks (recesses) between them.

3. For teaching (pedagogical) work performed with the consent of teaching staff in excess of the established norm of hours for the wage rate, additional payment is made in accordance with the received wage rate in a single amount.

4. Teachers who cannot be provided with a teaching load in the amount corresponding to the norm of hours of teaching work for the weekly wage rate are guaranteed payment of the wage rate in full, provided that they are supplemented to the established norm of hours by other teaching work in the following cases:

teachers of grades 1-4 when transferring the teaching of foreign language lessons, music, fine arts and physical education to specialist teachers;

teachers of grades 1-4 in rural general education institutions with a native (non-Russian) language of instruction who do not have sufficient training to teach Russian language lessons;

Russian language teachers in rural primary secondary schools with native (non-Russian) language of instruction;

physical education teachers of rural educational institutions, foreign language teachers of general educational institutions located in the villages of logging and rafting enterprises and chemical forestry enterprises.

5. Teachers, as well as teachers of educational institutions implementing educational programs of secondary vocational education of a pedagogical orientation (with the exception of teachers of such educational institutions for which the standard hours of teaching work have been established for a salary rate of 720 hours per year), who, for reasons beyond their control, have During the academic year, the academic load is reduced in comparison with the academic load established at the beginning of the academic year, until the end of the academic year, and also during vacation time that does not coincide with the annual main extended paid leave, the following is paid:

wages for the actual remaining number of hours of teaching work, if it exceeds the standard hours of teaching work per week established for the wage rate;

wages in the amount of a monthly rate, if the volume of the teaching load before it was reduced corresponded to the standard hours of teaching work per week established for the wage rate, and if they cannot be loaded with other teaching work;

wages established before the teaching load was reduced, if it was set below the standard hours of teaching work per week established for the wage rate, and if they cannot be loaded with other teaching work.

The specified teaching staff must be notified of a reduction in the teaching load during the academic year and of additional teaching work no later than two months in advance.

6. To teachers of educational institutions that implement educational programs of primary vocational and secondary vocational education, for whom, for reasons beyond their control, during the academic year, the teaching load decreases in comparison with the teaching load established at the beginning of the academic year until the end of the academic year, as well as in vacation time that does not coincide with the annual main extended paid leave, wages are paid in the amount established during the billing at the beginning of the academic year.

For teaching staff, a reduced working time of no more than 36 hours per week is established.

The teaching load of a teaching worker, stipulated in the employment contract, may be limited by an upper limit in cases provided for by the standard regulations on an educational institution of the relevant type and type, approved by the Government of the Russian Federation.

Depending on the position and (or) specialty of teaching staff, taking into account the characteristics of their work, the duration of working time (standard hours of teaching work per wage rate) is determined by the Government of the Russian Federation.

COMMENT 1.

For teaching staff of educational institutions, a reduced working time is established - no more than 36 hours per week.

In pursuance of the Federal Law of June 18, 2001 No. 77-FZ “On preventing the spread of tuberculosis in the Russian Federation” and the Decree of the Government of the Russian Federation of December 25, 2001 No. 892 “On the implementation of the Federal Law “On preventing the spread of tuberculosis in the Russian Federation”” by a joint order of the Russian Ministry of Health No. 225, the Ministry of Defense of Russia No. 194, the Ministry of Internal Affairs of Russia No. 363, the Ministry of Justice of Russia No. 1126, the Ministry of Education of Russia No. 2330, the Ministry of Agriculture of Russia No. 777 and the Federal Border Guard Service of Russia No. 292 dated May 30, 2003, approved the List of positions, the occupation of which is associated with the danger of infection with Mycobacterium tuberculosis, giving the right to additional paid leave, a 30-hour work week and additional wages in connection with harmful conditions labor.

For certain categories of teaching staff specified in the List, a 30-hour working week is established. These include: administrative positions, positions of teachers, educators and teachers of additional education, sanatorium-type health educational institutions for children infected with tuberculosis, the Russian sanatorium and rehabilitation center for orphans and children without parental care suffering from various forms tuberculosis infection, teachers and additional education teachers of general education institutions working in hospitals for children suffering from various forms of tuberculosis infection. 2.

The teaching load of a teaching worker in cases provided for by the standard regulations on an educational institution of the appropriate type and type may be limited to an upper limit.

Thus, according to clause 77 of the Model Regulations on an educational institution of higher professional education (higher educational institution) of the Russian Federation, approved. By Decree of the Government of the Russian Federation dated 04/05/2001 No. 264, for teaching staff of a higher educational institution, the educational load is established by the higher educational institution independently, depending on their qualifications and the profile of the department in the amount of up to 900 hours per academic year.

The teaching load of teachers of structural units in accordance with clause 28 of the Model Regulations on structural units of additional professional education (advanced training) of specialists organized in higher and secondary specialized educational institutions of the Russian Federation, approved. by Decree of the State Committee for Higher Education of Russia dated April 10, 1996 No. 2, is established depending on their qualifications and position held and cannot exceed 800 hours in one academic year.

According to clause 54 of the Model Regulations on an educational institution of secondary vocational education (secondary specialized educational institution), approved. By Decree of the Government of the Russian Federation dated March 3, 2001 No. 160, teaching staff, in the manner established by the legislation of the Russian Federation, enjoy the right to reduced working hours.

Teaching load for the academic year for secondary vocational teachers educational institutions stipulated in the employment agreement (contract) should not exceed 1440 hours.

In accordance with clause 50 of the Model Regulations on the Establishment of Primary Vocational Education, approved. By Decree of the Government of the Russian Federation dated 06/05/1994 No. 650, engineering and teaching workers, in the manner established by the legislation of the Russian Federation, enjoy the right to a standardized 6-hour working day and a shortened working week.

The teaching load for teachers is established independently by the institution of primary vocational education, depending on their qualifications and specific activities and cannot be lower than the minimum.

A teaching load below the minimum may be established subject to the written consent of the teacher.

Clause 66 of the Model Regulations on a General Educational Institution, approved. By Decree of the Government of the Russian Federation dated March 19, 2001 No. 196, the volume of teaching load (teaching work) of teaching staff is determined based on the number of hours according to the curriculum and curriculum, staffing levels, and other working conditions in a given educational institution.

The teaching load (teaching work), the volume of which is more or less than the standard hours for the wage rate, is established only with the written consent of the employee.

The volume of teaching load (teaching work) established at the beginning of the school year cannot be reduced during the school year at the initiative of the administration, with the exception of cases of reducing the number of hours in the curriculum and programs, reducing the number of classes (extended day groups).

Depending on the number of hours provided for in the curriculum, the teaching load of teaching staff may be different in the first and second academic semesters.

The volume of teaching load (teaching work) established in the current academic year cannot be reduced at the initiative of the administration in the next academic year, with the exception of cases of reducing the number of hours in the curriculum and programs, reducing the number of classes (extended day groups).

When determining the teaching load for the new academic year, teachers and other teaching staff for whom this general education institution is the place of their main work, as a rule, maintain its volume and continuity of teaching subjects in classes.

A pedagogical worker of a general education institution, with his consent, by order of the general education institution may be assigned the functions of a class teacher in organizing and coordinating educational work with students in the classroom.

By Decree of the Government of the Russian Federation of December 30, 2005 No. 850, from January 1, 2006, teaching staff of federal state educational institutions established a monthly remuneration for performing the functions of a class teacher in the amount of 1000 rubles.

Payments for classroom management, made as of December 31, 2005, remained at the same amount. 3.

The duration of working hours (standard hours of teaching work per wage rate) of teaching staff of educational institutions is determined by the Government of the Russian Federation depending on the position and (or) specialty, taking into account the characteristics of their work.

In order to implement this norm of Art. 333 of the Labor Code of the Russian Federation, the Decree of the Government of the Russian Federation dated 04/03/2003 No. 191 “On the duration of working hours (standard hours of teaching work for the wage rate) of teaching staff of educational institutions” was issued.

This resolution established the length of working hours (standard hours per wage rate) for all teaching staff in all types of educational institutions.

For teaching staff of educational institutions, depending on their position and (or) specialty, taking into account the characteristics of their work, the following is established: 1)

working hours:

a) 36 hours a week - to employees from among the teaching staff of educational institutions of higher professional education and educational institutions of additional professional education (advanced training) specialists;

b) 30 hours a week - for senior teachers of educational institutions (except for preschool educational institutions and educational institutions for additional education of children);

c) 36 hours a week: -

senior teachers of preschool educational institutions and educational institutions of additional education for children; -

educational psychologists, methodologists (senior methodologists), social educators, teacher-organizers, industrial training masters, senior counselors, labor instructors of educational institutions; -

heads of physical education of educational institutions of primary vocational and secondary vocational education; -

teacher-organizers (basics of life safety, pre-conscription training) of general education institutions, institutions of primary vocational and secondary vocational education; - instructors-methodologists (senior instructors-methodologists) of educational institutions of additional education for children with a sports profile. 2)

standard hours of teaching work per wage rate (standardized part of teaching work):

a) 18 hours a week: -

teachers of grades 5-11(12) of general education institutions (including cadet schools), general education boarding schools (including cadet boarding schools), educational institutions for orphans and children left without parental care, special (correctional) educational institutions for students (pupils) with developmental disabilities, health educational institutions of sanatorium type for children in need of long-term treatment, special educational institutions of open and closed type, educational institutions for children of preschool and primary school age, educational institutions for children in need of psychological, pedagogical and medical and social assistance, interschool educational centers, training and production workshops; -

teachers of pedagogical schools and pedagogical colleges; -

teachers of special disciplines 1-11 (12) classes of musical, artistic educational institutions; -

teachers of grades 3-5 of schools of general musical, artistic, choreographic education with a 5-year term of study, grades 5-7 of art schools with a 7-year term of study (children's music, art, choreographic and other schools), grades 1-4 of children's art schools and schools of general art education with a 4-year period of study; -

teachers of additional education; -

trainers-teachers (senior trainers-teachers) of educational institutions of additional education for children in sports; -

foreign language teachers of preschool educational institutions;

b) 20 hours a week - for teachers of grades 1-4 of general education institutions;

c) 24 hours a week - teachers of grades 1-2 of schools of general music, art, choreographic education

with a 5-year term of study, 1-4 classes of children's music, art, choreography and art schools with a 7-year term of study;

d) 720 hours per year - for teachers of primary and secondary vocational education institutions. 3)

standard hours of teaching work per wage rate:

a) 20 hours a week - for speech pathologists and teachers-speech therapists;

b) 24 hours a week - for music directors and accompanists;

c) 25 hours a week - for teachers of educational institutions working directly in groups with students (pupils) with developmental disabilities;

d) 30 hours a week - to physical education instructors, educators in boarding schools, orphanages, extended day groups of educational institutions, in school boarding schools;

e) 36 hours a week - for teachers of preschool educational institutions, preschool groups of general education institutions and educational institutions for children of preschool and primary school age, institutions of additional education for children and institutions of primary vocational and secondary vocational education.

When applying the above standards, the following should be kept in mind.

The working hours of teaching staff include teaching (educational) work, educational work, as well as other pedagogical work provided for by job responsibilities and working hours, approved in the prescribed manner.

For teaching work performed with the consent of teaching staff in excess of the established norm of hours for the wage rate, additional payment is made in accordance with the received wage rate in a single amount in the manner determined by the Ministry of Education and Science of Russia.

The standard hours of teaching and (or) teaching work for the wage rate of teaching staff is established in astronomical hours.

For teachers, instructors, and additional education teachers of educational institutions, the standard hours of teaching work include the lessons (classes) they conduct, regardless of their duration, and short breaks (recesses) between them.

Wage rates for teachers and other teaching staff are set based on their working time in astronomical hours. Short breaks (breaks) provided between lessons (classes) are the working time of the teacher (teacher, additional education teacher).

The duration of the lesson is determined by the educational institution. Typically, the lesson duration is 45 minutes. An educational institution reducing the duration of a lesson for students does not entail a reduction in the teacher’s working hours. Only the number of lessons (lessons) set per rate remains unchanged. So, if a teacher is assigned a teaching load of 25 hours of teaching work per week, then he conducts 25 lessons (lessons) of 35, 40, 45 minutes each (i.e., as determined by the educational institution), and the rest of the time falls on breaks from active recreation students. Thus, in this case, the teacher must work (including breaks between lessons) 25 astronomical hours per week (not 36 hours).

For additional work that is not included in the scope of the main duties (for example, checking written work, class management, managing a classroom, etc.), the teacher is given an additional payment, the amount of which is determined in accordance with Art. 32 and 54 of the Law of the Russian Federation of July 10, 1992 No. 3266-1 “On Education”, by the educational institution independently.

Teachers who cannot be provided with a full teaching load are guaranteed payment of the salary rate in full, provided that they are supplemented with other teaching work to the established standard hours in the following cases:

a) teachers of grades 1-4 when transferring the teaching of foreign language lessons, music, fine arts and physical education to specialist teachers;

b) teachers of grades 1-4 in rural general education institutions with a non-Russian language of instruction who do not have sufficient training to teach Russian language lessons;

c) teachers of the Russian language in rural primary secondary schools with a non-Russian language of instruction;

d) physical education teachers of rural general educational institutions, foreign language teachers of general educational institutions located in the villages of logging and rafting enterprises and chemical forestry enterprises.

Teachers of general education institutions and teachers of pedagogical schools and pedagogical colleges, whose teaching load during the academic year, for reasons beyond their control, is reduced in comparison with the established load, are paid until the end of the academic year:

a) wages for the actual number of hours, if the remaining workload is higher than the established rate;

b) wages in the amount of the rate, if the remaining workload is below the established rate for the rate and if it is impossible to supplement them with other teaching work;

c) wages established before the teaching load was reduced, if it was set below the norm for the rate and if it is impossible to supplement them with other teaching work.

Teachers of institutions of primary vocational and secondary vocational education, whose teaching load for reasons beyond their control during the academic year is reduced in comparison with the established load, are paid until the end of the academic year a salary in the amount established during the tariff calculation at the beginning of the academic year.

Teaching staff must be notified of a reduction in the teaching load during the year and of additional teaching work no later than two months in advance.

Letter of the Ministry of Education of Russia dated January 22, 1998 No. 20-58-07in/20-4 “On speech therapists and educational psychologists in educational institutions” determines the salary rates for speech therapists of all educational institutions, regardless of their departmental subordination, paid for 20 hours teaching work per week. In this case, it does not matter in what level of classes the speech therapist teacher carries out pedagogical activities. Teachers-speech therapists and educational psychologists of psychological-medical-pedagogical consultations, which are independent institutions, are paid a salary rate for 36 hours of teaching work per week. 4.

Exception from new edition Part 3 Art. 333 of the Labor Code of the Russian Federation, the norm on allowing teaching staff to work part-time, including in a similar position or specialty, does not mean a ban on them from such work. It should be kept in mind the changed approach to legal regulation labor relations related to part-time work and combination of professions (positions). In this regard, it is necessary to pay attention to the introduction of new articles 601 and 602 in the Code, which specifically regulate these works.

Furthermore, in accordance with Art. 282 of the Labor Code of the Russian Federation, the specifics of regulating part-time work for teaching staff can be established in the manner determined by the Government of the Russian Federation, taking into account the opinion of the RTK. Decree of the Government of the Russian Federation dated 04.04.2003 No. 197 “On the peculiarities of part-time work in pedagogical, medical, pharmaceutical workers and cultural workers” was instructed to establish the features of part-time work for teaching staff of the Ministry of Health and Social Development of Russia in agreement with the Ministry of Culture of Russia, the Ministry of Education and Science of Russia and taking into account the opinion of the RTK.

The features of part-time work for teaching staff are defined in Resolution of the Ministry of Labor of Russia dated June 30, 2003 No. 41 “On the features of part-time work for teaching, medical, pharmaceutical and cultural workers.”

According to this resolution, teaching staff have the right to carry out part-time work - performing other regular paid work under the terms of an employment contract in their free time from their main job at the place of their main job or in other organizations, including in a similar position, specialty, profession, and in cases where reduced working hours are established (except for work in respect of which regulatory legal acts The Russian Federation has established sanitary and hygienic restrictions).

The duration of part-time work for teaching staff (including trainers, teachers, trainers) during the month is established by agreement between the employee and the employer, and for each employment contract it cannot exceed half of the monthly working time rate, calculated from the established duration of the working week . Therefore, based on the fact that the working hours of teaching staff should not exceed 36 hours per week, the duration of part-time work cannot exceed 18 hours per week.

For teaching staff (including trainers, teachers, trainers), whose half of the monthly working time for their main job is less than 16 hours per week, the duration of part-time work cannot exceed 16 hours of work per week. For cultural workers involved as teachers of additional education, accompanists, choreographers, choirmasters, accompanists, artistic directors, the duration of part-time work cannot exceed the monthly standard of working time, calculated from the established length of the working week.

Pedagogical work of highly qualified specialists on a part-time basis, with the consent of the employer, can be carried out in educational institutions for advanced training and retraining of personnel during regular working hours while maintaining wages at the main place of work.

For teaching staff, this is not considered a part-time job and does not require the conclusion (registration) of an employment contract. the following types works:

a) literary work, including work on editing, translation and reviewing individual works, scientific and other creative activities without holding a full-time position;

b) carrying out technical, accounting and other examinations with a one-time payment;

c) teaching work on conditions hourly pay no more than 300 hours per year;

d) consulting by highly qualified specialists in institutions and other organizations in the amount of no more than 300 hours per year;

e) supervision of graduate students and doctoral students by employees who are not on the staff of the institution (organization), as well as the head of the department, management of the faculty of an educational institution with additional payment by agreement between the employee and the employer;

f) teaching work in the same institution of primary or secondary vocational education, in a preschool educational institution, in an educational institution of general education, an institution of additional education for children and other children's institution with additional pay;

g) work without holding a full-time position in the same institution or another organization, including the performance by teaching staff of educational institutions of duties in managing offices, laboratories and departments, teaching work of managers and other employees of educational institutions, management of subject and cycle commissions, work according to the guide industrial training and practice of students and other students, etc.;

h) work of teaching staff in the same educational institution or another children's institution in excess of the established norm of hours of teaching work for the wage rate;

i) work on organizing and conducting excursions on an hourly or piece-rate basis without holding a full-time position.

Carrying out the work specified in subparagraph. “b”-“z” is allowed during regular working hours with the consent of the employer.

The duration of part-time work is determined by agreement between the employee and the employer and cannot exceed, for each employment contract, half of the monthly working time calculated from the established duration of the working week. If half of the monthly norm for the main job is less than 16 hours per week, then part-time work should not exceed 16 hours per week. In addition, there is no limit to the number of employment contracts that an employee can enter into. It is important that the duration of work under each part-time employment contract does not exceed half the monthly working time standard.

36 hours is not the norm, but the maximum

The working hours of teaching staff in educational institutions are regulated by Articles 92 and 333 of the Labor Code of the Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation), paragraph 5 of Article 55 of the Law of the Russian Federation “On Education” (as amended by the Federal Law of January 13, 1996 No. 12-FZ with subsequent amendments and additions), Decree of the Government of the Russian Federation of April 3, 2003 No. 191 “On the duration of working hours (standard hours of teaching work for the wage rate) of teaching staff of educational institutions.”

The peculiarities of the working time regime of teaching staff are regulated by the Regulations on the peculiarities of the working time regime and rest time of teaching and other employees of educational institutions, approved by order of the Ministry of Education and Science of the Russian Federation dated March 27, 2006 No. 69, registered with the Ministry of Justice on July 26, 2006, registration No. 8110 (hereinafter referred to as the Regulations on the Peculiarities of the Working Time Regime).

Federal legislation establishes reduced working hours for teaching staff - no more than 36 hours per week.

However, in Article 333 of the Labor Code of the Russian Federation, along with the indication that the working time of teaching staff is no more than 36 hours per week, there is a very significant clarification. It states that depending on the position and (or) specialty of teaching staff, taking into account the characteristics of their work, the duration of working hours is determined by the Government of the Russian Federation.

Consequently, the words “working hours no more than 36 hours” are not a generally established working time and not mandatory for all teaching staff. This is its maximum norm, which the Government of the Russian Federation can establish for a teaching worker occupying one position (depending on its name and characteristics of work) or receiving one wage rate.

Taking these conditions into account, by Decree of the Government of the Russian Federation of April 3, 2003 No. 191 “On the duration of working hours (standard hours of teaching work for the wage rate) of teaching employees of educational institutions” (hereinafter referred to as Decree No. 191), teaching workers established either the duration of working hours or the norm hours for one wage rate.

The duration of working hours, amounting to 30 or 36 hours of teaching work per week, is established for the categories of teaching workers provided for in paragraph 1 of the appendix to resolution No. 191. The standard hours for one wage rate, amounting to 18, 20, 24, 25, 30, 36 hours per week or 720 hours per year, are fixed for the categories of workers listed in paragraphs. 2 and 3 appendices to this resolution. For example, a 30-hour working time per week is established for senior educators in all educational institutions, except for preschool educational institutions and children's institutions of additional education.

The working hours of 36 hours per week are established:

Senior teachers of preschool educational institutions and children's institutions of additional education;

Educational psychologists;

Methodists (senior methodologists) of educational institutions;

Social educators;

Teacher-organizers;

Masters of industrial training;

Senior counselor;

Labor instructors of educational institutions;

Teacher-organizers (basics of life safety, pre-conscription training) of general education institutions, institutions of primary vocational and secondary vocational education;

Heads of physical education of educational institutions of primary vocational and secondary vocational education;

Employees from among the teaching staff of educational institutions of higher professional education and educational institutions of additional professional education (advanced training) specialists;

Instructors-methodologists (senior instructors-methodologists) of educational institutions of additional education for children with a sports profile.

It should also be noted that remuneration for teaching staff, for whom working hours are established, is carried out on the basis official salaries, and teaching staff for whom the standard hours per rate are established - based on wage rates.

For teaching staff provided for in paragraph 2 of the appendix to Resolution No. 191, that is, teachers, lecturers (except for university teachers and IPK), teachers of additional education and trainers, the norm of teaching hours per salary wages- only a standardized part of working time, since they job responsibilities are not limited to teaching work only.

After the teaching load for the new academic year is established for teachers, lecturers, additional education teachers, trainers, the normalized part of their working time will be the amount of educational (pedagogical) load established by them, the implementation of which is regulated by the schedule of lessons (study sessions) in classes, groups, and circles , sections, clubs and other student associations.

The amount of remuneration for a teaching load that is more or less than the norm is subject to a proportional increase or decrease compared to the size of their wage rate.

The duration of the standardized part of the teaching work of teaching staff is determined in astronomical hours and includes classes conducted regardless of their duration and short breaks (changes) between them (footnotes 3 and 4 of the appendix to resolution No. 191).

In addition to teaching load

The teacher’s salary rate is paid both for performing teaching work within the established hours, and for performing other duties provided for by the tariff-qualification (qualification) characteristics.

The job responsibilities of employees conducting pedagogical work in addition to teaching work are specified in paragraph 2.3 of the Regulations on the peculiarities of the working time regime.

The work of teachers, instructors, additional education teachers, and teacher trainers outside of classroom activities does not have clear boundaries and standards, since it depends on various circumstances.

At the same time, the nature of the above-mentioned pedagogical work provides that its implementation, as a rule, is not carried out on certain working days of the week, but is calculated for longer periods: for a month, an academic quarter, a half-year, an academic year, and therefore such work must be regulated by the relevant plans and work schedules.

The establishment of any time standards for its implementation, which artificially increase the working time of teaching staff beyond the normalized part of it associated with teaching work, is not provided for, with the exception of the time standard determined by the Regulations on special regime working hours for teachers to be on duty during the educational process. Teaching staff are called to duty at an educational institution on weekdays no earlier than 20 minutes before the start of classes and no later than 20 minutes after the end of the last class.

So what to do during the holidays?

The peculiarities of the working hours of teaching staff are also associated with the presence in most educational institutions of a vacation period established for students. A vacation period that does not coincide with the annual main and additional holidays teaching staff of educational institutions - working hours for them. The duration of their working hours during the autumn, winter, spring and summer holidays established for students and pupils is not subject to change.

Heads of educational institutions, including sanatorium-forest schools and boarding schools, do not have the right to set for teachers during the holiday period the working hours provided for educators.

During this period, teachers (with the exception of teachers of primary and secondary vocational education institutions, as defined in paragraph 4.5 of the Regulations on the peculiarities of the working time regime) carry out pedagogical, methodological, as well as organizational work within the normalized part of their working time. Wherein we're talking about on working hours corresponding to the established volume of teaching load or teaching work, determined by him before the start of the holidays.

An increase in their working hours during the holiday period to perform the work provided for in paragraph 2.3 of this Regulation is possible only in cases where the corresponding activities or types of work are announced for this period in accordance with schedules and plans.

If such events and work are not planned for the vacation period, then the involvement of employees conducting teaching work in performing pedagogical, methodological, and organizational work during this period is limited to the normalized part of their working time, that is, the number of hours of teaching load before the start of the vacation.

During the period of work during the autumn, winter, spring and summer holidays of students, remuneration for teachers, additional education teachers, and trainers is made based on the wages established during the tariff calculation prior to the start of the holidays.

A different work procedure during the vacation period has been determined for teachers of primary and secondary vocational education institutions due to the fact that the normalized part of their working time is determined in the form of the annual teaching load.

In accordance with clause 4.5 of the Regulations on the peculiarities of the working time regime, teachers of these educational institutions are involved in the work of methodological commissions, seminars, professional development events, as well as in the organization and conduct of cultural events, in the work of subject cycle commissions, and staffing classrooms , laboratories. During this period, these employees are paid an average monthly salary.

In a similar manner, the Regulations on the Peculiarities of the Working Time Regime regulates the working hours of employees of educational institutions during the period of cancellation for students, pupils of educational classes (educational process) on sanitary-epidemiological, climatic and other grounds.

Involvement in work during the holiday period, as well as during the period of cancellation of classes for the above reasons, is carried out on the basis of the relevant administrative documents of the educational institution, which simultaneously determine the duties performed by employees and the work schedule. When drawing up this schedule, with the consent of the employee, the volume of the established weekly teaching load (teaching work) can be scheduled for fewer days per week or month compared to the previously established schedule.
